Need for Lemon Law in India

The year 2015 was milestonic in Indian constitutional history as it had 125th birth anniversary of the Great Dr. B.R. Ambedkar. He played an instrumental role in shaping the Indian Constitution and drafting the constitutional values enshrined in it. His significant contributory efforts led to the adoption of Indian Constitution on 26th of November, 1949. In the light of this historical and contemporary realities, the Union ministry of social justice notified the decision of the Centre to celebrate November 26 as “Constitution Day” or “Samvidhan Diwas” to be celebrated each year from 2015 onwards to promote constitutional values among citizens.

However, its use and misuse are mostly regulated through piecemeal regulations in the form of guidelines and certain age-old acts, like Digital Media is regulated by the Ministry of Electronics and Information Technology (MEITY), Film Media is regulated by Cinematograph (Certification) Rules 1983 and the Cable Television Networks (Regulation) Act 1995 regulates the operation of cable television networks in India. So, we can say that the Media & Entertainment (M&E) industry in India has the right to the freedom of the press and this freedom of media is to be recognized at all levels of legal regulation, this freedom must not be absolute and must not be allowed to be a weapon in the hands of media to frustrate the democratic spirit of Indian society. The potential of the media must be sensibly regulated to explore its true spirit of being an effective tool for information dissemination.

Indian Constitution guarantees Freedom of trade and commerce but it is not absolute, some limitations are built into such freedom which is being discussed further in the article.
